nope, DC would kill it (there was someone here a year ago who did that).
For everyone else avatars: as long as there is no way to find a special copyright, or when it's from some ava gallery, you could use it.
why do you want dc's ava????
if someone would use my avatar he could easily be mixed up with me. that would not be good since I'm the admin and he is not. my avatar even says admin so he would be a liar too. therefore I do not want anyone to use my avatar. I'm even going to ban people if they do use my avatar more than one time (first time they just get warned)

Haha yes its easier to use than PS...
So I made another version with paint:
The dark side of DC 
I think it wont be mistaken for DC's
I removed "admin"too,so just fill yr name in
I spent about half an hour to make it...It's quite bored to use paint...
